When a potential employee is checked by the National Vetting Bureau, their criminal record (if applicable) is forwarded to the registrant`s authorized liaison officer – see “How to Apply” below. A review disclosure will include details of all convictions and prosecutions in progress, as well as a statement containing specific information* (if applicable) or a statement that there is no criminal record or specific information about the person being examined. A request for disclosure of the examination made under section 13 of the Act must contain information about the person referred to in subsection (5). Section 20 of the Act refers to the reconsideration of employees (and other workers) who have already been screened for their current position after a certain period of time (called a certain period). However, this deadline has not yet entered into force. The government is currently considering introducing a mandatory review every 3 years. The National Standards for Children`s Homes state that all staff, students and volunteers must be properly screened before commencing their activities, including references and criminal record checks from the Garda Síochána and/or the Police Department. The Child Protection (Special Care) Regulations 2004 require the HSE or voluntary institution or any other person providing or maintaining a special care unit to ensure that staff or other persons with access to children are adequately screened. That is, by obtaining references and criminal record checks from Garda Síochána and/or other police authorities. Reference to subsequent verification is made in section 21 of the Act. The organization concerned must, within the time prescribed by the Minister, apply for reconsideration of the disclosure in respect of that person if a request for review of the disclosure under the Act has not yet been made for the person concerned. Convictions for certain minor offenses handed down by the district court that are more than 7 years old are not included in the disclosure of the review. The only exception to this rule is where the organizations concerned have entered into a joint written agreement in accordance with section 12 (3A) of the Act. In the absence of these documents, an applicant has the option of filing an affidavit or affirmation before a commissioner of oaths to verify his or her identity.
